Terms & Conditions:

1. Reservation of Rights:
All rights not expressly granted above are retained by the Artist, including any electronic rights or usage and including, but not 
limited to, all rights for sketches, comps, or other preliminary works or materials. The Artist retains the right of usage for self-promotion,
including placement in portfolio.

2. Revisions and timeline:
Artist agrees to submit 2 stages for client’s approval. Client bears responsibility of initial contact to facilitate work. Within 96 hours of initial client
contact one thumbnail and idea proposition is required for artist to have completed stage one. After client feedback, verbal or written confirmation
to proceed to stage two is given or a stage one revision is granted. Artist has one full week for subsequent stage two submission or five 
business days for revision of stage one. Client gives verbal or written confirmation to proceed to final render after stage two. 
Artist is given one week for final render gaurantee after stage 2.

Additional fees may be incurred to Client for revisions made after one free revision at either stage one or two. Revisions at any point 
delay project deadline by five business days as aforementioned. Fees are incurred at $40 an hour (AU) for second revision or subsequent revisions or Artist retains 
the right to deny revisions. Feedback that reflects a new direction for the assignment and illustration cancels all timeline commitments 
and Artist reserves the right for project cancellation at any time in case of new conceptual or directional input outside of stage revisions. 
Artist is responsible for delivering work of a rendered quality similar to images on website but is not held legally binding to any objective 
project or deliverable specification. Upon dissatisfaction the Client agrees to offer Artist the first opportunity to make any changes to 
final artwork to meet original service standards as shown on website shopfront.

3. Cancellation and Kill Fees:
NA as payment is up front.

4. Refunds and Returns:
If the Artist cannot meet project deadlines or complete an image to the indicated level of quality on website shopfront with one oppurtunity for revision
a full refund to the Client will be offered. Under no circumstances is the artist further lagally bound for any subjective or 
objective level of service or quality. What is ultimately promised by the sale of service is an image rendered to the level promised, 
and the artist cannot be held responsible for the dissatisfaction of an ultimately objective vision in the eye of the Client by way of legal liability. 

5. Permissions & Releases:
The client agrees to indemnify and hold the Artist harmless against any and all claims, costs, and expenses, including attorney’s
fees, due to materials included in the Work at the request of the Client for which no copyright permission or privacy release was 
requested or for which uses exceed the uses allowed pursuant to a permission or release. Any changes to final work including layout,
orientation, colour or otherwise must be passed and permission obtained from the artist before they are made.

6. Miscellany:
This agreement shall be binding upon the parties, their heirs, successors, assigns, and personal representatives. This agreement
constitutes the entire understanding of the parties. Its terms can be modified only by an instrument in writing signed by both 
parties. Any dispute regarding this agreement shall be arbitrated in South Australia under South Australian legislation. The artist is not
responsible for spelling errors or accidental image likeness once the piece has been cleared for final production.
